Emergency Situation Release Right to Enter and Mitigate Damage
1. Before taking any mitigating action, and unless it believes that further delay will cause permanent or additional damage to your home, Public Safety will attempt to contact you, or your representative, at the telephone number listed on the Emergency Contact Form included with this Release and Right to Enter. If you or your representative cannot be contacted immediately, Public Safety is authorized to take reasonable mitigating action and to contact you as soon as possible. It is your responsibility to ensure that your contact information is correct.2. You grant Public Safety the right to enter, forcibly if necessary, and/or remain on the premises for as long as they believe is reasonably necessary to respond to the emergency and/or to take actions that will mitigate damage to your home and property. This may include contracting for outside emergency service personnel, such as plumbers, electricians or flood and fire restoration experts, on your behalf. You will be responsible for all costs associated with services contracted by Public Safety for you.3. You agree to release, relieve, discharge and hold harmless Cordillera Metropolitan District and Cordillera Property Owners Association from any and all responsibility and liability, whether for personal injury, property damage or otherwise, arising out of or in connection with the actions contemplated in this Release and Right to Enter.4. If you do not sign and return this Release and Right to Enter, it will be considered a refusal for Public Safety to act on your behalf in an emergency situation. However, if you complete and return the Emergency Contact Form, Public Safety will make reasonable attempts to contact you and inform you of an emergency situation existing at your home.
